1. Acceptance of Terms
By installing or using the Smart Popups application (the “App”) on your Shopify store, you agree to be bound by these Terms & Conditions. If you do not agree, do not install or use the App.
2. Description of Service
Smart Popups lets you create and display trigger-based popups on your Shopify storefront, including time-delay, exit-intent, scroll depth, and page-view triggers, with audience targeting and design customization. Features may change, be added, or be removed at any time.
3. Use of the App
You are responsible for the content displayed in your popups and for ensuring it complies with applicable laws, Shopify’s policies, and the rights of third parties. You agree not to use the App for any unlawful, misleading, or abusive purpose.
4. Plans & Billing
The App may offer free and paid plans. Paid plans are billed through Shopify’s billing system in accordance with the pricing shown at the time of subscription. Charges are subject to Shopify’s billing terms, and you authorize the recurring charges associated with your selected plan.
5. Data & Privacy
The App accesses store data only as necessary to provide its functionality and in line with the permissions you grant during installation. We process data in accordance with applicable data protection laws and Shopify’s requirements. You are responsible for disclosing the use of popups to your customers where required.
6. Disclaimer of Warranties
The App is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, or that it will increase sales or conversions.
7. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss of profits or revenue, arising out of or related to your use of the App.
8. Termination
You may stop using the App at any time by uninstalling it from your Shopify store. We reserve the right to suspend or terminate access to the App if these Terms are violated.
9. Changes to These Terms
We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
